Terms of Service

2. Accounts

• You must provide accurate account information and keep your login credentials secure.
• You are responsible for all activity under your account.
• We may suspend or terminate your account if you violate these Terms.

3. Services & AI Output

• You may submit prompts, media, or data ("Customer Input") to generate content using AI models ("Output Content").
• Outputs may not be unique and may contain inaccuracies.
• You are solely responsible for reviewing and using any Output.

4. Ownership & Licenses

• You retain ownership of your Customer Input.
• You own Output Content generated from your Input, subject to third‑party rights.
• You grant us a limited license to process your Input and Output to operate and improve our Services.
• We own all rights in the Services, AI models, software, and aggregated Usage Data.

5. Prohibited Uses

You may not use the Services to:

Illegal & Harmful Content

• Create, upload, or distribute CSAM, pornography, sexually explicit, obscene, or indecent content.
• Generate or promote hate speech, harassment, terrorism, extremism, violence, gore, or self‑harm.
• Create misleading political/media content, impersonations, or deepfakes without consent.
• Violate any law or third‑party rights (including copyright, trademarks, publicity, or privacy).

Security & Abuse

• Distribute malware, phishing, scams, spam, or unauthorized advertising.
• Attempt to reverse‑engineer, extract source code, or build competing products.
• Circumvent security measures, overload systems, or misuse compute resources.
• Sell, resell, or sublicense Services without permission.

We may review, suspend, or terminate accounts that violate these rules, and cooperate with law enforcement where required.

6. Fees & Payments

• Services may require credits, subscriptions, or fees.
• Credits tied to subscriptions expire at the end of the billing cycle; purchased top‑ups do not expire.
• Except where required by law, all purchases are final and non‑refundable.
• Prices exclude taxes; you are responsible for applicable taxes.

7. Termination

• You may delete your account at any time; unused credits are not refunded.
• We may suspend or terminate access if you breach these Terms, fail to pay, or pose a legal/security risk.

8. Privacy & Data Protection

• Our Privacy Policy explains how we handle personal data.
• We comply with global privacy laws, including GDPR (EU), CCPA (California), and India’s DPDP Act, 2023.

9. Indemnification

You agree to indemnify and hold harmless the Company and its affiliates from any claims or damages arising out of your use of the Services, your Inputs or Outputs, or your violation of these Terms.

10. Disclaimers

• Services are provided “as is” with no warranties.
• We do not guarantee availability, accuracy, or originality of Outputs.
• You are solely responsible for legal compliance in your use of Outputs.

11. Limitation of Liability

• Our total liability is capped at the greater of USD $50 or the amount you paid in the past 12 months.
• We are not liable for indirect or consequential damages.

Some jurisdictions may not allow exclusions; in such cases, your rights remain.

12. Dispute Resolution

• First, contact us at support@cravix.ai to attempt informal resolution.
• Except where prohibited by law, disputes will be resolved by binding arbitration (Arbitration and Conciliation Act, 1996 for India, or equivalent in other jurisdictions).

13. Governing Law

These Terms are governed by the laws of India. For users in India, these Terms are also subject to the Information Technology Act, 2000 and the Consumer Protection Act, 2019.

14. General

• These Terms are the full agreement between you and us.
• If a section is unenforceable, the rest remains in effect.
• We may assign these Terms; you may not assign without consent.
